Terms and Conditions

The Rockford’s Rock Opera website, products and services are provided by Sweetapple Ltd. We can be contacted by email at: rockford@sweetapple.co.uk. Use of our Sites/Apps and purchases of our products and services are subject to our Terms and Conditions set out here.

Any access to or use of rockfordsrockopepra.com and sweetapple.co.uk (including all subpages and any other related webpages published by Sweetapple Ltd., collectively referred to herein as the “Sites”) is subject to and constitutes your acceptance of the following terms (these “Terms of Use”):

We reserve the right to modify these Terms from time to time at our sole discretion. Therefore, you should review these Terms periodically. When we change the Terms in a material manner, we will notify you that material changes have been made to the Terms through notification via e-mail, social media and on the website. Your continued use of the website or our products after any such change constitutes your acceptance of the new Terms. If you do not agree to any of these terms or any future version of the Terms, do not use or access (or continue to access) the website or the products.

1. All rights in the Sites and its products, services, contents, including trademarks, symbols and slogans, text, data, images, audio-visual content, graphics, music or layout, whether registered or unregistered, are owned either by Sweetapple Ltd. or by our third party licensors and are protected by applicable laws.

2. Unless otherwise expressly specified, you must not:

2.1. copy, reproduce, adapt, store, transmit to any third party, exploit or otherwise use any item contained on the Sites in any way other than normal web viewing as a user or potential user of our products or services.

2.2. remove, hide, modify or otherwise interfere with any copyright and authorship notices;

2.3. create any hypertext links, or any other links between the Sites and your site or with any third party site without Sweetapple Ltd’s written permission;

2.4. frame, “deep link”, “page scrape”, mirror and/or create a browser or border environment around any of the services, except as expressly permitted by Sweetapple Ltd, in advance and in writing.

2.5. use any “robot”, “spider” or other automatic device, program, script, algorithm, or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of the services (or its data), or in any way reproduce or circumvent the navigational structure or presentation of any of the services to obtain or attempt to obtain any materials, data, documents, services or other information through any means not purposely made available through the services;

2.6. reverse look-up, trace, or seek to trace another user of the services, or otherwise interfere with or violate any other user’s right to privacy or other rights, or harvest or collect personally identifiable information about visitors or users of the services and/or Sweetapple Ltd or Rockford’s Rock Opera without their express and informed consent;

2.7. disable, circumvent, bypass or otherwise avoid any measures used to prevent or restrict access to the services, the account of other users, or any other systems or networks connected to the services, by hacking, password mining, or other illegitimate or prohibited means;

2.8. probe, scan, or test the vulnerability of the services or any network connected to the services; disrupt or interfere with the any other user’s use of the Sites, or otherwise abuse the Sites, or any services, security, system resources, accounts, servers, or networks connected to or accessible through the Sites or affiliated or linked websites;

2.9. upload to the services and/or the Sites (or otherwise use them to design, develop, distribute and/or otherwise transmit or execute) any virus, worm, Trojan Horse, time bomb, web bug, spyware, malware, or any other computer code, file, or program that may or is intended to damage or hijack the operation of any hardware, software, or telecommunications equipment, or any other actually or potentially harmful, disruptive, or invasive code or component;

2.10. take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the services or our systems or networks, or otherwise interfere with or disrupt the operation of any of the services;

3. Sweetapple Ltd. / Rockford’s Rock Opera is not responsible for any third party websites or applications linked to from the Sites (including advertisers) and we exclude any and all liability for any content, advertising, products, services, advice, data use or any other matter arising out of accessing such sites or applications, including their processing of personal data, which may differ from our policies.

4. Any personal details which you provide to Rockford’s Rock Opera, Sweetapple Ltd. or the Sites will only be used in accordance with our Privacy Policy.

5. These Terms of Use are governed by and construed in accordance with English law, and you agree that any dispute or claim related to the Sites will be subject to the exclusive jurisdiction of the courts of England, except that Sweetapple Ltd/Rockford’s Rock Opera can ask any court to protect its intellectual property rights or confidential information.

6. When using our website, third parties, including Social Media websites, may use cookies, web beacons, and other storage technologies to collect or receive information from this website and elsewhere on the internet and use that information to provide measurement services and target ads. Users can opt-out of the collection and use of information for ad targeting. 7. Copyright

The website, products and all materials therein or transferred thereby, including, without limitation, text, images, graphics, logos, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Sweetapple Ltd/Rockfords Rock Opera. Except as explicitly provided, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and by use of our site and products you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works.

 

8. Shop

Products may be accessed either by becoming a site member and gaining direct access to all our resources, or by purchasing resources to download individually.  When buying an item, you agree that: (i) you are responsible for reading the full item listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process. Products on our website consist of downloadable files, the links to which are e-mailed to the customer on completion of the sale.  Links are valid for 30 days and can also be requested after this time by contacting us directly through the website.  We accept no responsibility for difficulties in downloading or accessing these materials if there are issues out of our control, such as entering incorrect contact information at the point of sale, or technical issues with downloading and opening the purchased files.

Site membership allows access to the Members Area. Membership will not be renewed automatically though we will contact you about extending your membership before it expires.  

Discounts are supplied at our discretion and will be honored if the correct code is entered at check-out.  Discount Codes are only to be used in connection to the e-mail address they are supplied to and should not be passed onto any third party.  We are unable to apply discounts after purchase.

9. Products

The prices we charge for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. We also reserve the right to use, change or cancel promotions and discount codes at any time.  We may, without prior notice, also change the products or stop providing access to any part of the website at any time.

Products downloaded are at the user’s own risk, and we cannot accept any responsibility for any harm caused by downloading and use of the files we provide, including if files have been modified by a third party without our knowledge.

Purchased products are provided for the exclusive use of the buyer and the institution to which they professionally belong, such as their school or educational establishment.  Materials can be shared and used according to the membership selected but sharing or copying of materials beyond this is deemed a breach of copyright and these Terms.

 

10. Refund Policy

Due to the nature of the product being an instant download, once products have been purchased and the download link has been sent, or if access to the members-only pages has been granted, refunds will not usually be possible except in exceptional circumstances.  This will be at our discretion but will include technical issues for which we are responsible (such as corrupt files).  Purchases made in error, or an inability to download resources due to giving us incorrect contact information, require you to give us immediate notification of the error and may be refunded at our discretion.

For tangible products, our refund and returns policy lasts 30 days. If 30 days have passed since your purchase, we can’t offer you a full refund or exchange.
To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
